By signing up for any Influencer, Yoga Challenge or Ambassador Program or by using our ambassador or yoga challenge discount code you agree to the following:

1. Ownership Rights: Brand Ambassador and or Influencer acknowledges that the results and proceeds of the services provided hereunder, including without limitation all ideas, photographs, images, themes, materials, and designs developed, created and/or provided by Brand Ambassador and or Influencer (the “Work”) is owned by SEAAV Athletics US Inc., for all purposes. To the extent that any Work is deemed not to be a work made for hire, and without limiting the foregoing, Brand Ambassador and or Influencer hereby assigns and transfers all right, title, ownership and interest therein, presently known or hereafter ascertained, including, but not limited to, all copyright rights therein, the right to secure the copyright (and all renewals, reissues and extensions thereof) throughout the world, without any restrictions as to use, to SEAAV Athletics US Inc. For the sake of clarity, and without in any way limiting the foregoing, SEAAV Athletics US Inc may reproduce, modify, adapt, create derivative works from, distribute, display, license, assign, transfer and/or otherwise use the Work, and all elements and derivatives thereof, in whole or in part, in all media now known or hereafter developed (including without limitation in social media), worldwide, in perpetuity, royalty-free and without restriction of any kind. Brand Ambassador and or Influencer acknowledges the ownership and validity of SEAAV Athletics US Inc copyrights, brands, trademarks, trade dress and patent rights, whether or not created by or contributed to by Brand Ambassador and or Influencer.

2. Use of Likeness: Brand Ambassador and or Influencer further grants to SEAAV Athletics US Inc. the irrevocable right and permission to film, videotape, photograph and/or otherwise record Brand Ambassador and or Influencer and to reproduce, publish, distribute, display, broadcast, exhibit, and/or in any other way use Brand Ambassador and or Influencer’s image, likeness, signature, voice, photographs, name (including nicknames), actual and/or paraphrased statements, biographical information and/or any other information or attribute identifying and/or otherwise associated with Brand Ambassador and or Influencer (collectively, “Likeness”), in whole or in part, distorted, altered, modified and/or adapted in character and/or in form, alone and/or accompanied by other material, in perpetuity and royalty-free, for any purpose whatsoever, including without limitation for the purpose of advertising, publicity, promotion, and/or other marketing for SEAAV Athletics US Inc. and/or the Work, in all media now known or hereafter developed (including without limitation in social media).

3. No Right of Approval: Brand Ambassador and or Influencer hereby irrevocably waives any and all right to inspect and/or approve SEAAV Athletics US Inc. use of the Work and/or Brand Ambassador and or Influencer’s Likeness, including without limitation any text, image and/or other creative elements that may be used in connection with the Work and/or Brand Ambassador and or Influencer’s Likeness.

4. Commission is null if ambassador code is found on any coupon, discount or affiliate sites. Your discount code is meant to be shared with friends, family and followers. Commission is null if Influencer or Ambassador does not own any SEAAV and or has not posted in SEAAV on their Instagram. 

5. Any participation in SEAAV’s in person or online activities is at the ambassador’s own risk.

This Privacy Policy of UpPromote about Affiliate Marketing system describes how we may collect and use personal data and the rights granted to merchants, affiliates and customers regarding their respective data.

By joining the Affiliate program, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you must not use the affiliate marketing system.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to our affiliate program after these changes are posted, you agree to the revised policy.

Personal Information Controller

Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).

Information collected from Merchants

When merchant uses the app, we are automatically able to access certain types of information from your Shopify account such as email, first name, last name, shop information (shop domain, shop currency, shop address …). We collect this information to provide you with our Services; for example, to confirm your identity, contact you, provide customer support when you contact us, provide you with advertising and marketing activities.

Information collected from Affiliates

When an Affiliate signs up to join a program, we collect some information to inform merchants such as email, personal information, payment details and social network information,...The information would help merchant evaluate affiliate background and potential, along with process specific activities within the app and contact affiliate if needed.

Information collected from Customers when visiting merchant website

In order to track referral order, when customers visit merchant website and make a purchase, UpPromote system will collect information of order such as total order, order items, order ID,....

Use of UpPromote app by Children

UpPromote is not intended for children. If you are under 13, you may use the affiliate marketing system only with the supervision of your parent or guardian.

UpPromote understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are using the system and wish to exercise these right, please contact us through info@seaav.ca. We may require that you provide us with acceptable verification of your identity before providing access to such information.

If you are an affiliate and wish to exercise these rights, please contact the merchant you interacted with directly — we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
